IMPORTANT NOTICE: By signing this agreement, you give up the right to sue for any injury or damages howsoever caused.

In consideration of being permitted to participate in activities and access the facilities provided by Nature’s Elements Wellness Inc., located at the private residence of Tania and Daniel Deluis, including but not limited to sauna sessions, ice baths, yoga, breathwork, spa-like amenities, and nature trails (“Activities”), the undersigned acknowledges, appreciates, and agrees to the following terms:

COMPLIANCE WITH INSTRUCTIONS: I hereby agree to comply with all instructions, guidelines, and rules provided by Nature’s Elements Wellness Inc., Tania and Daniel Deluis, or their representatives, concerning participation in Activities. I understand that non-compliance may result in termination of participation without refund.

INFORMED ASSUMPTION OF RISK: I am aware that participation in the Activities involves inherent risks and dangers of accidents, personal and bodily injury (including death), and property loss or damage. These risks may result from my own actions or inactions, the actions or inactions of others participating in the Activities, or the condition in which the Activities take place. I understand that these risks may arise from foreseeable or unforeseeable causes, and I freely and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation.

RELEASE OF LIABILITY: To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Nature’s Elements Wellness Inc., its directors, officers, employees, volunteers, agents, and representatives (collectively, the “Releasees”) from any and all liability to me, my personal representatives, assigns, heirs, and next of kin for any loss or damages, and any claim or demands on account of injury to my person or property or resulting in my death, whether caused by the negligence of the Releasees or otherwise, arising out of or related to my participation in the Activities or my presence at the facilities.

INDEMNITY: I agree to indemnify, save, and hold harmless the Releasees from any loss, liability, damage, or cost they may incur due to my presence in or upon the area where the Activities are being conducted, whether caused by my negligence or otherwise.

ACKNOWLEDGEMENT OF HOME-BASED BUSINESS: I acknowledge that Nature’s Elements Wellness Inc. operates from the private residence of Tania and Daniel Deluis and that the unique nature of the setting may include typical residential risks in addition to those associated with the Activities.

FITNESS AND HEALTH: I declare that I am fit to participate in the Activities. I have no medical conditions that would affect my safety or health, or others’ safety or health, during my participation. I consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activities, and I understand that I am responsible for any expenses incurred.

JURISDICTION: This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada. Any disputes arising out of this agreement shall be subject to the exclusive jurisdiction of the courts of Ontario.

ENTIRE AGREEMENT: This agreement constitutes the entire agreement between the parties concerning the subject matter hereof and replaces and supersedes all prior negotiations, proposed agreements, and agreements, whether written or oral.

ACKNOWLEDGEMENT: I acknowledge that I have read and understood this agreement, that I am signing it voluntarily, and that I am not relying on any statements or representations of any party released by this agreement.
